1. ACCEPTANCE OF TERMS

AQUARQ ("we", "our", or "us") provides this website and its contents subject to the terms set out below. By accessing this website, submitting an enquiry, or placing an order with us, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please discontinue use of the website.

2. PRODUCTS AND DESCRIPTIONS

AQUARQ manufactures and supplies packaged drinking water in 250 ml, 500 ml and 1 litre formats from our facility in Hapur, Uttar Pradesh. Product imagery, label mockups and packaging visuals shown on this website are for representation purposes and may differ in minor respects from delivered goods. We reserve the right to revise product specifications, formats and availability without prior notice.

3. ENQUIRIES AND ORDERS

Enquiries submitted through this website — including bulk supply, distributor and custom branding requests — constitute an expression of interest and do not form a binding contract. An order is confirmed only when accepted by us in writing, along with agreed quantities, pricing, delivery schedule and payment terms. We reserve the right to decline any enquiry or order at our discretion.

4. CUSTOM BRANDING

• Artwork Responsibility: Where you supply a logo, mark or artwork for custom label integration, you confirm that you own or are licensed to use that material, and that its use does not infringe any third-party rights.
• Proof Approval: Production commences only after you approve the label proof shared by us. Approved proofs are treated as final, and we are not liable for errors present in approved artwork.
• Minimum Quantities: Custom-branded and glass-format orders are made to order and may be subject to minimum order quantities and extended lead times, confirmed at the time of order.

5. PRICING AND PAYMENT

Prices are quoted per order and remain valid for the period stated in the quotation. Unless expressly stated otherwise, prices exclude applicable taxes, delivery and handling charges. Payment terms, including any advance payable against custom or bulk orders, will be set out in the confirmed order.

6. DELIVERY

Delivery timelines shared by us are estimates made in good faith and are not guaranteed. We are not liable for delays arising from circumstances beyond our reasonable control, including transport disruption, regulatory action, or supply constraints. Risk in the goods passes to you on delivery to the agreed address.

7. QUALITY, STORAGE AND CLAIMS

Our water is produced under FSSAI licence number 12726073000057 and is subject to in-house quality control with periodic independent laboratory validation. Goods must be stored in cool, dry conditions away from direct sunlight and strong odours, and consumed before the date marked on the pack. Claims relating to shortage, damage or condition on arrival must be raised in writing within 48 hours of delivery, with the affected batch details retained for inspection.

8. INTELLECTUAL PROPERTY

The AQUARQ name, logo, "Pure by Nature" tagline, label design, site content and imagery are our property or are used under licence, and may not be reproduced, distributed or used without our prior written consent. Any artwork you supply for custom branding remains your property, and you grant us a limited licence to use it solely to fulfil your order.

9. LIMITATION OF LIABILITY

To the extent permitted by applicable law, our liability in respect of any order is limited to the value of the goods supplied under that order. We are not liable for indirect or consequential loss, including loss of profit or business. Nothing in these terms excludes liability which cannot lawfully be excluded.

10. GOVERNING LAW

These Terms & Conditions are governed by the laws of India. Any dispute arising in connection with them shall be subject to the exclusive jurisdiction of the courts at Hapur, Uttar Pradesh.
